His inaction violated Business and Professions Code, section 6068(i), which requires attorneys to cooperate fully with the State Bar in investigations of potential misconduct. The failure to cooperate is a significant breach of professional duties, and in disciplinary cases, it is often seen as an aggravating factor.
Neglect of Client Case
The second major charge stems from Tweedy’s neglect of a case involving his client, Cathie Luckey. In November 2019, Luckey hired Tweedy to represent her in legal action against the City of Lathrop. However, over the course of nearly four years, Tweedy failed to file a lawsuit, initiate arbitration, or make any demands against the city. His failure to perform these basic legal services constitutes a breach of Rules of Professional Conduct, rule 1.3(a), which mandates that attorneys perform their duties with diligence. This prolonged neglect left Luckey’s case unresolved and her legal interests unprotected.
